FLORIDA SUPREME COURT RULING WIPES OUT ASSET PROTECTION FOR SINGLE MEMBER LLCS.
In a June 26, 2010, decision the Florida Supreme Court held that Florida law permits a court to order a judgment debtor to surrender all right, title, and interest in the debtor‘s single-member limited liability company to satisfy an outstanding judgment. (Olmstead v. Federal Trade Commission) Individuals with single member LLCs should consider changing the ownership makeup of the LLC or the form of entity to a limited partnership.
